These Terms of Service ("Terms") govern your access to and use of the ThisRide mobile application (the "App"), our website located at thisride.com (the "Site"), and any related services, features, and content (collectively, the "Service"). • Use any automated system, including "bots," "spiders," or "offline readers," to access the Service in a manner that sends more request messages to the ThisRide servers than a human can reasonably produce in the same period by using a conventional web browser.
• Upload, post, or share any content that is illegal, defamatory, obscene, pornographic, harassing, or that infringes on any third party's intellectual property or privacy rights.
• Impersonate another person or entity.

4. User-Generated Content

Our Service allows you to upload, submit, and share content, such as vehicle photos, reviews, and comments ("User Content").

Your Ownership: You retain all ownership rights to your User Content.

License You Grant to Us: By submitting User Content, you grant ThisRide a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with providing and promoting the Service. This license is necessary for us to display your review or photo within the App and to our community.

Your Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the User Content you submit. You agree not to submit content that contains personally identifiable information of others (such as visible license plates or people in photos) without their express consent.

We reserve the right to remove any User Content at our discretion and without notice.

5. Third-Party Services, Affiliates, and Lead Generation

The Service is designed to be a useful automotive hub, which may include displaying links and information from third-party businesses. You acknowledge and agree to the following:

• Affiliate Links: We may include affiliate links for products and services, such as vehicle history reports (e.g., CARFAX), auto parts suppliers, and online marketplaces. If you purchase through these links, we may earn a commission at no additional cost to you.

• No Endorsement: ThisRide is not responsible for and does not endorse any third-party products, services, or websites. Your interactions with any third party found on or through our Service are solely between you and the third party.

6. "ThisRide Pro" and Other Premium Services

We may offer certain enhanced features of the Service for a fee ("Premium Services"), such as a subscription to "ThisRide Pro."

Billing: By purchasing a Premium Service, you agree to pay the specified fees. Payments will be billed on a pre-paid basis (monthly or annually) and are non-refundable, except as required by law.

Automatic Renewal: To ensure uninterrupted service, your subscription will automatically renew at the end of the subscription period for the same duration. You authorize us to charge your selected payment method for the renewal subscription fees.

Cancellation: You may cancel your subscription at any time through your account settings or the applicable app store (e.g., Apple App Store, Google Play Store). Your cancellation will take effect at the end of the current billing cycle.

7. Intellectual Property

Excluding your User Content, all materials within the Service, including the text, software, graphics, photos, logos, and trademarks ("Our Content") are the property of ThisRide or our licensors and are protected by copyright and other intellectual property laws. You are granted a limited, non-sublicensable license to access and use the Service for your personal, non-commercial use.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, THISRIDE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF.

WE DO NOT WARRANT THAT THE VEHICLE IDENTIFICATION FEATURE OR ANY DATA PROVIDED (INCLUDING SPECIFICATIONS, VALUATIONS, OR REVIEWS) IS ACCURATE, COMPLETE, RELIABLE, OR ERROR-FREE. ALL INFORMATION IS FOR INFORMATIONAL PURPOSES ONLY. YOU SHOULD INDEPENDENTLY VERIFY ANY INFORMATION BEFORE RELYING ON IT FOR A PURCHASE OR REPAIR DECISION.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THISRIDE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, OR (III) ANY BUGS, VIRUSES, OR TROJAN HORSES WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY.

OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM ARISING, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless ThisRide and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

11. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by following the instructions on the Service.
